Lee Jae-myung, chairman of the Democratic Party of Korea, has applied to the court for an additional request for an unconstitutional legal trial ahead of the ruling of an appeals court on charges of violating the Public Official Election Act.

According to the legal community on the 12th, representative Lee submitted an application for an unconstitutional legal trial to the Seoul High Court's Criminal Department 6-2 (presiding judge Choi Eun-jung) the previous day. However, the purpose of the detailed application is not known.

The request for an unconstitutional legal trial is a procedure in which the court requests the Constitutional Court to determine whether laws directly related to the trial are unconstitutional. It is done ex officio or at the request of the parties. Last month, representative Lee also applied for an unconstitutional legal trial for Article 250 (1) of the Public Official Election Act (the crime of publicizing false facts).

However, it is a variable that the number of subjects to be reviewed by the court has increased as representative Lee has newly applied for an unconstitutional legal trial. If the court accepts the request for an unconstitutional legal trial, the trial will be suspended until the Constitutional Court decides. This is why it has been pointed out that representative Lee is trying to delay the trial. If the court rejects the application, representative Lee can file a constitutional petition, but in this case, the trial continues.

CEO Lee's appeal is scheduled for the 26th. In November last year, the first trial court sentenced Lee to one year in prison and two years of probation, which is a nullification of the election.
